Sexually Delinquent Person
In Michigan, there are many attorneys who claim to know about sex crimes and how to prevent a person from being designated as a sexually delinquent person. However, attorneys who regularly practice sex crime defense know that being labeled a sexually delinquent person can have severe consequences.
A sexually delinquent person is defined under Michigan Statute MCL 750.10(a) as “any person whose sexual behavior is characterized by repetitive or compulsive acts which indicate a disregard of consequences or the recognized rights of others, or by the use of force upon another person in attempting sex relations of either a heterosexual or homosexual nature, or by the commission of sexual aggressions against children under the age of 16.” This means that a person who has committed one certain sexual act against an adult male, an adult female, or a minor under 16 years old will be considered a sexually delinquent person if he or she engages in other unlawful or forceful acts that are also sexual in nature.
A defendant who is accused and convicted as a sexually delinquent person will face imprisonment that can range from 1 day in jail to a life sentence. Unlike certain other crimes, being charged as a sexually delinquent person can seriously affect a person’s job, family, and livelihood. If so convicted, a person will be considered a Tier 1 sex offender and is required to register with the Michigan Sex Offender Registry.
