Michigan Sex Crime Attorneys Tier 1 Sex Crime Convictions
In July, 2011, Michigan laws dealing with sex offender registration were drastically changed. Now, sex offenders on the registry are divided into three tiers, with Tier 1 being the least serious tier.
Tier 1 sex crime convictions include:
- Criminal Sexual Conduct (CSC) 4th degree against a victim aged 18 or older
- Assault with intent to commit CSC 2nd degree against a victim aged 18 or older
- Indecent exposure with self-fondling in front of minor
- Possession of child sexually abusive material (child pornography)
- Unlawful imprisonment/restraint of a minor
- A sex offense committed by a sexually delinquent person
- Surveillance of or distribution, dissemination, or transmission of a recording or image of a minor with a reasonable expectation of privacy
- A violation of a state or local law that, by its nature, constitutes a sexual offense against a minor
- A substantially similar offense to the ones described above under the laws of another jurisdiction
- An attempt or conspiracy to commit any of the above
People on Tier 1 must remain there for 15 years. Though they will not be on Michigan’s public sex offender registry, they will be in the private law enforcement database and must still go to the police station to verify their address and other information one time each year. This verification occurs between January 1 and January 15 each year.
Some people on Tier 1 will be eligible to ask the court for immediate removal from the sex offender registry or a length reduction.
